Что говорит законодательство?
Действующее законодательство достаточно подробно регламентирует вопросы, связанные с осуществлением всех мероприятий и сроками проведения капитального ремонта многоквартирного дома. 
Основным нормативным актом, осуществляющим регулирование таких вопросов, является Жилищный Кодекс Российской Федерации. Именно он регулирует сроки проведения капитального ремонта в жилых домах.
Так, ч. 1 ст. 166 Жилищного Кодекса регламентирует перечень работ, который должен производиться в рамках капитального ремонта многоквартирного дома.
Что же касается сроков проведения ремонта в многоквартирных домах, то в каждом регионе периодичность выполнения таких работ устанавливается конкретно исходя из особенностей технической эксплуатации того или иного жилого строения.
Например, в условиях вечной мерзлоты ремонт фундаментов как основной конструкционной составляющей того или иного дома должен проводиться не реже чем раз в десять лет, а в средней полосе России в случае отсутствия экстремальных разрушающих факторов срок устанавливается раз в 25 лет.
Конкретных требований к такому числу дней в настоящий момент в законодательстве не существует, однако все работы, например, по ремонту инженерных коммуникаций должны быть проведены в период, когда предыдущий отопительный сезон закончен и не начат новый.
А как узнать сроки капитального ремонта дома? Об этом мы расскажем в следующих разделах этой статьи.
Периодичность выполнения работ
Ключевым вопросом, касающимся в настоящее время капитального ремонта многоквартирных домов, является вопрос периодичности, с которой такой ремонт должен осуществляться для существующего жилого фонда. Через сколько лет делают капремонт многоквартирного дома?
И здесь желающие найти ответ на него столкнутся с достаточно серьезной проблемой, а именно отсутствием четкой регламентации этого момента в действующем законодательстве.
Так, Жилищный Кодекс РФ в разделе 9, полностью посвященном вопросам капитального ремонта, не дает даже приблизительных сроков, по истечении которых должны проводиться те или иные работы.
Ответ на этот вопрос придется искать в ГОСТах на те или иные материалы, а также в специализированных инструкциях, созданных для регламентации выполнения тех или иных работ.
Например, для канализационных труб, изготовленных из пластика, минимальный срок эксплуатации, в течение которого они будут полноценно обеспечивать безопасное существование жильцов в многоквартирном доме, составляет 60 лет, для металлических – в два раза меньше, а чугунные – около 20 лет ( ГОСТ 286-82 ).
Таким образом, периодичность выполнения работ по капитальному ремонту для каждого дома должна устанавливаться индивидуально исходя из того, какие коммуникации и инженерные сооружения должны подвергаться ремонту или реконструкции. Об этом говорит и Пункт 1.7. Инструкции о составе, порядке разработки, согласования и утверждения проектно-сметной документации на капитальный ремонт жилых зданий, утвержденной Постановлением Госстроя №79 от 17 декабря 1999 года и вступившей в силу с 1 января 2000 года.
Как узнать сроки проведения капитального ремонта конкретного дома?
Многие задают актуальный вопрос: можно ли как-то узнать сроки проведения капитального ремонта дома? Отвечаем, узнать срок капитального ремонта дома можно. А как — расскажем ниже.
Так как даже новостройки через несколько лет их эксплуатации (как правило, срок составляет от трех до пяти лет) включаются в разноуровневые программы капитального ремонта (как федеральные, так и региональные), любой житель того или иного многоквартирного дома может узнать срок капитального ремонта многоквартирного дома по адресу.
Для того, чтобы получить информацию через сколько лет проведут капитальный ремонт дома, можно действовать тремя путями:
- первый путь подразумевает обращение в собственное ТСЖ или в свою управляющую компанию с целью выяснения, на какой год дом включен в программу капитального ремонта;
- вторым путем станет обращение в администрацию того населенного пункта, в котором находится дом, с аналогичной первому пути целью выяснения нахождения здания в перечне программы капитального ремонта;
- третий путь будет наименее затратным с точки зрения времени и сил, так как позволит выяснить всю необходимую информацию через сайт программы Содействия реформированию ЖКХ (при условии, что дом включен в соответствующую региональную программу).
Что делать, если ремонт нужен срочно?
Бывают такие ситуации, когда дом определен в ремонт через десять лет, а необходимость в нем наступает уже срочно (например, из-за постоянно протекающей кровли необходимо срочно менять электрическую проводку во всем доме, чтобы избежать короткого замыкания и пожара).
Возможен ли перенос срока капитального ремонта на более ранний? Как быть в этой ситуации? Неужели нельзя передвинуть начало ремонта?
Так как его проведение возможно только после согласования специальных смет на выполнение работ, то сразу после принятия решения о переносе сроков ремонта начать работы не удастся. На такое согласование уходит, как правило, около 6 месяцев.
Кроме того, согласно ч.3 ст. 189 Жилищного Кодекса РФ, не менее, чем за 6 месяцев до начала года, в котором должен осуществляться ремонт, лицо, ответственное за содержание в надлежащем состоянии общедомового имущества (чаще всего им является председатель ЖСК или ТСЖ) должен довести соответствующую информацию до собственников помещений с подробной расшифровкой всех положений о проводимых работах, а также провести собрание среди жильцов с целью утверждения всех смет и перечня проводимых работ.
То есть, за год до начала проведения ремонта (если он проводится в запланированные изначально сроки), жильцы начинают процесс согласования смет на проведение работ и осуществляют довнесение недостающих средств на счет, на котором накапливаются деньги на проведение работ.
Для переноса срока начала ремонта или изменение положения конкретного дома в рамках региональной программы, необходимо обратиться в свою управляющую компанию (а в случаях с ТСЖ – в подразделение в администрации муниципалитета) с целью вызова для осмотра состояния дома специальной комиссии, которая по результатам осмотра нуждающихся в ремонте, реконструкции или замене тех или иных инженерных частей дома, вынесет соответствующее представление с указанием сроков обязательного проведения ремонтных работ.
Исключение может составить только внеплановый, который будет назначен по итогам осмотра всего здания оценочной комиссией.
Сроки проведения работ
Работы по капитальному ремонту представляют собой достаточно сложные по затратам как человеческих сил, так и материальных ресурсов, виды деятельности, которые должны выполняться очень тщательно, так как зачастую, от их качества будут зависеть эксплуатационные возможности того или иного здания, а также безопасность его жильцов. 
Именно по этой причине такие работы не могут выполняться за один день. Однако, и быть растянутыми на несколько лет они тоже быть не могут.
Если для текущего ремонта Приложение №6 к Постановлению Госстроя № 170 от 27.09.2003 года определило сроки в 22 рабочих дня на проведение всех необходимых работ, то относительно капитального оговоренных в законодательстве их нет.
Однако, если обратиться к ч. 5 ст. 189 Жилищного Кодекса, можно увидеть, что сроки проведения работ по капитальному ремонту утверждаются непосредственно на собрании собственников жилья в многоквартирном доме.
Таким образом, можно сказать, что жильцы сами должны определить, в течение какого времени должны быть выполнены все работы.
Если время подошло, а ремонта нет?
Бывают и такие случаи, когда время проведения капитального ремонта подошло, а он не осуществляется. Как быть в таких случаях? Причин, по которым такая ситуация может сложиться, бывает несколько. Среди них можно выделить три наиболее важные:- недостаток средств, которые были накоплены на счете регионального оператора;
- исключение дома из региональной программы капитального ремонта по причине признания его аварийным;
- отказ управляющей компании в осуществлении ремонта по причине нежелания проводить такие работы.
С последней причиной можно бороться только путем обращения в контролирующие органы с соответствующим коллективным заявлением (сначала – в Жилищную инспекцию, затем – органы Прокуратуры и суды). А вот с первыми двумя справиться легче.
Что касается недостатка средств, то его можно покрыть путем внесения соответствующей графы в квитанции об оплате содержания жилья (разделив недостающую сумму на количество проживающих в доме или квадратных метров всего, а также на количество месяцев, оставшихся до конца календарного года, так как именно в рамках года осуществляется оплата всех заключенных контрактов).
В том случае, если дом признали аварийным и исключили из программы, необходимо обратиться в те государственные или муниципальные органы, которые ответственны за принятие таких решений, и потребовать предоставить акт осмотра здания с подписанным заключением.

Сроки, объем работ и порядок оплаты разъясняются в Жилищном Кодексе Российской Федерации от 29.12.2004 N188-ФЗ. Согласно статье 166 «Капитальный ремонт общего имущества в многоквартирном доме» Жилищного кодекса, капремонт включает в себя:
- ремонт или замену лифтов и сопутствующего оборудования;
- ремонт или замену инженерных систем;
- ремонт или замену крыш, подвалов, фасадов.
- собственники МКД на общем собрании по предложению председателя ТСЖ;
- управляющей компании или регионального оператора;
- орган местного самоуправления, если собственники не приняли подобного решения.
Как узнать сроки проведения капитального ремонта конкретного дома
Жилищный кодекс РФ не дает определенного ответа, какой срок необходим для проведения капитального ремонта. Для каждого дома этот срок будет строго индивидуален в зависимости от степени изношенности его объектов и используемых материалов. Любой собственник жилого помещения имеет право получить информацию, касающуюся времени проведения капремонта. Сделать это можно несколькими способами, самым удобным из которых является отправка запроса через официальный сайт Реформа ЖКХ.Через интернет

- в основной части документа указываются информация о доме и просьба обозначить сроки проведения ремонта, если они имеются, или включить дом в региональную программу;
- в конце ставится дата и личная подпись.

В случае если домом управляет Товарищество собственников жилья, информация о сроках реализации должна находиться у председателя организации. Любые работы по проведению капитального ремонта здания требуют не только большого объема финансовых затрат, но и определенных знаний и умений. Так как от качества проведенных работ будет зависеть не только комфортное проживание собственников, но и их безопасность, капремонт обычно затягивается на продолжительное время. Нередко возникают ситуации, когда время капитального ремонта пришло, а подрядчик не торопится выполнять свои обязательства. Это может возникнуть, когда:- на счете конкретного дома не хватает средств;
- изъятие земельного участка государством или признание дома аварийным;
- отказ ответственной организации выполнять капремонт.

When I originally commented I seem to have clicked on the -Notify
me when new comments are added- checkbox and from now on whenever a comment is added
