1.Страховщик – акционерное общество «Минутка» – заключил с гражданином Седовым договор страхования его жизни и здоровья. По условиям договора страховая выплата должна быть произведена в случае смерти или заболевания, указанного в перечне, приложенном к правилам страхования. При медицинском обследовании, предшествовавшем заключению договора, у предполагаемого страхователя был выявлен цирроз печени. По мнению врачей, причиной этого заболевания были периодические, весьма длительные запои Седова. Убедившись в плачевном состоянии своего здоровья, Седов решил начать вести трезвый образ жизни. Страховщик, в свою очередь, согласился заключить с ним договор страхования, в который была включена обязанность Седова бросить пить. При этом цирроз печени был исключен из перечня заболеваний, при возникновении которых производится выплата.
Однако и после заключения договора Седов продолжал злоупотреблять спиртными напитками и через год умер от цирроза печени. Родственники Седова потребовали от страховщика произвести предусмотренную договором выплату. Страховщик отказался это сделать, сославшись на то, что причиной смерти стало поведение самого Седова, который в нарушение договора продолжал пьянствовать и умышленно довел себя до смерти. Следовательно, отсутствовал страховой случай, который с точки зрения закона должен обладать признаками случайности и вероятности наступления. Дело передано в суд.
Какое решение должен вынести суд? Изменится ли решение, если цирроз печени был оставлен в перечне заболеваний, при возникновении которых производится выплата?
Гражданин Седов пренебрег условиями договора страхования, и начал употреблять спиртные напитки, тем самым увеличил страховой риск в период действия договора страхования. Согласно ст. 959 Гражданского кодекса РФ, страхователь обязан незамедлительно сообщать страховщику о ставших ему известными значительных изменениях в обстоятельствах, сообщенных страховщику при заключении договора, если эти изменения могут существенно повлиять на увеличение страхового риска.
Значительными во всяком случае признаются изменения, оговоренные в договоре страхования (страховом полисе) и в переданных страхователю правилах страхования. Также, гражданин Седов не сообщил страховщику изменения обстоятельств, а именно употребление алкоголя в период действия договора страхования, грубо нарушил условия договора и обязанности страхователя (ст. 939 ГК РФ), на основании изложенного, необходимо отказать в иске родственникам гражданина Седова.
2.Страховое общество «Эсквайр» заключило комбинированный договор страхования автомобиля, принадлежавшего Яковлеву, жизни и здоровья водителя и пассажиров и гражданской ответственности водителя – гражданина Сидорова, управляющего автомобилем по доверенности. В период действия договора друг Сидорова – Петров, управляя автомобилем, сбил пешехода Иванова, причинив ему телесные повреждения, в результате которых тот стал инвалидом II группы с постоянно назначенной пенсией. Кроме того, автомобиль был полностью уничтожен и не подлежал восстановлению.
Страховое общество выплатило Сидорову, находившемуся в момент аварии в автомобиле, стоимость автомобиля и начало выплачивать возмещение Иванову, после чего обратилось в суд с регрессным иском, требуя взыскать с Петрова стоимость автомобиля и суммы, уже выплаченные Иванову. Петров иск не признал.
Решите данный спор. Изменится ли решение, если будет установлено, что Петров незаконно завладел автомобилем?

Глава 48 Статья 929 пункт 1 ГК РФ 1. По договору имущественного страхования одна сторона (страховщик) обязуется за обусловленную
договором плату (страховую премию) при наступлении предусмотренного в договоре события (страхового случая) возместить другой стороне (страхователю) или иному лицу, в пользу которого заключен договор (выгодоприобретателю), причиненные вследствие этого события убытки в застрахованном имуществе либо убытки в связи с иными имущественными интересами страхователя (выплатить страховое возмещение) в пределах определенной договором суммы (страховой суммы). Глава 48 Статья 931 пункты 1 и 2ГК РФ 1. По договору страхования риска ответственности по обязательствам, возникающим вследствие причинения вреда жизни, здоровью или имуществу других лиц, может быть застрахован риск ответственности самого страхователя или иного лица, на которое такая ответственность может быть возложена. 2. Лицо, риск ответственности которого за причинение вреда застрахован, должно быть названо в договоре страхования. Если это лицо в договоре не названо, считается застрахованным риск ответственности самого
страхователя. Глава 25 Статья 395 п.1,2,3 ГК РФ 1. За пользование чужими денежными средствами вследствие их неправомерного удержания, уклонения от их возврата, иной просрочки в их уплате либо неосновательного получения или сбережения за счет другого лица подлежат уплате проценты на сумму этих средств. Размер процентов определяется существующей в месте жительства кредитора, а если кредитором является юридическое лицо, в месте его нахождения учетной ставкой банковского
процента на день исполнения денежного обязательства или его соответствующей части. При взыскании долга в судебном порядке суд может удовлетворить требование кредитора, исходя из учетной ставки банковского процента на день предъявления иска или на день вынесения решения. Эти правила применяются, если иной размер процентов не установлен законом или договором. 2. Если убытки, причиненные кредитору неправомерным пользованием его денежными средствами, превышают
сумму процентов, причитающуюся ему на основании пункта 1 настоящей статьи, он вправе требовать от должника возмещения убытков в части, превышающей эту сумму. 3. Проценты за пользование чужими средствами взимаются по день уплаты суммы этих средств кредитору, если законом, иными правовыми актами или договором не установлен для начисления процентов более короткий срок. Из всего выше изложенного следует, что Петров должен выплатить всю стоимость автомобиля, с компенсациямиИванова, и проценты компании Эсквайр. Если бы Петров незаконно завладел автомобилем, решение бы не изменилось.
3.Цыфиркин застраховал принадлежащий ему на праве собственности колбасный завод и риск неполучения прибыли от его эксплуатации на сумму 100 тыс. руб. В результате поджога неизвестным злоумышленником заводу был причинен ущерб на сумму 80 тыс. руб. 30% суммы ущерба составили потери доходов от выпуска и продажи колбас. По мнению независимого оценщика, отраженному в полисе, стоимость завода на момент заключения договора страхования составила 200 тыс. руб.
Рассчитайте сумму страхового возмещения. Изменится ли решение, если в полисе будет сказано, что «возмещению подлежит любой ущерб в пределах страховой суммы»?
Сумма страхового возмещения:
Т. К. Цифиркин оформил страховку на 100 тыс. руб. при том, что стоимость завода на момент страхования составляла 200 тыс. руб. ( 50 % стоимости), то и возмещению подлежит только 50% суммы ущерба.
12 т.р. – страховое возмещение от выпуска и продажи колбас
28 т.р. – страховое возмещение колбасного завода.
Итого: 40 тыс. руб.
Система пропорциональной ответственности – организационная форма страхового обеспечения. Предусматривает выплату страхового возмещения в заранее фиксированной доле (пропорции). Страховое возмещение выплачивается в доле суммы ущерба, пропорциональной отношению страховой суммы к страховой стоимости объекта страхования. Например, если страховая сумма равна 80% страховой стоимости объекта страхования, то и страховое возмещение составит 80% суммы ущерба. Оставшаяся часть ущерба (в данном примере 20%) остается на собственном удержании (риске) страхователя.
2) Если в полисе будет сказано, что «возмещению подлежит любой ущерб в пределах страховой суммы», то решение изменится. Страховое возмещение составит 80 тыс. руб. т.е. фактически всю сумму страхового ущерба.
Система первого риска – организационная форма страхового обеспечения. Предусматривает выплату страхового возмещения в размере фактического ущерба, но не больше, чем заранее установленная сторонами страховая сумма. При этом весь ущерб в пределах страховой суммы (первый риск) компенсируется полностью, а ущерб сверх страховой суммы (второй риск) вообще не возмещается.
4.В договоре страхования была предусмотрена обязанность страхователя немедленно, но не позднее пяти дней, сообщить страховщику о наступившем страховом случае – угоне автомобиля. Причем такое извещение должно быть сделано страхователем путем личной явки в офис страховщика. Однако после заключения договора страхования страхователь продал автомобиль. Покупатель автомобиля обратился в страховую компанию на третий день после угона, но не был пропущен в офис страховщика его службой безопасности, поскольку в страховом полисе был назван совершенно иной страхователь. Только на десятый день покупателю удалось встретиться с руководством страховщика и сообщить о наступившем страховом случае. Тем не менее в выплате страхового возмещения страхователю было отказано по причине пропуска срока заявления о страховом случае. Страхователь обратился в суд с иском, ссылаясь на то, что факт угона автомобиля подтверждается постановлением о возбуждении уголовного дела.
Решите дело. Какова природа срока подачи заявления о наступлении страхового случая?
Статья 961. Уведомление страховщика о наступлении страхового случая
1. Страхователь по договору имущественного страхования после того, как ему стало известно о наступлении страхового случая, обязан незамедлительно уведомить о его наступлении страховщика или его представителя. Если договором предусмотрен срок и (или) способ уведомления, оно должно быть сделано в условленный срок и указанным в договоре способом.
Такая же обязанность лежит на выгодоприобретателе, которому известно о заключении договора страхования в его пользу, если он намерен воспользоваться правом на страховое возмещение.
2. Неисполнение обязанности, предусмотренной пунктом 1 настоящей статьи, дает страховщику право отказать в выплате страхового возмещения, если не будет доказано, что страховщик своевременно узнал о наступлении страхового случая либо что отсутствие у страховщика сведений об этом не могло сказаться на его обязанности выплатить страховое возмещение.
3. Правила, предусмотренные пунктами 1 и 2 настоящей статьи, соответственно применяются к договору личного страхования, если страховым случаем является смерть застрахованного лица или причинение вреда его здоровью. При этом устанавливаемый договором срок уведомления страховщика не может быть менее тридцати дней.
1) По полису Страхователем является первый собственник, т. е. тот который продал, полис это как доверенность – продал – переписал, по осаго он же сразу застраховал свой авто, так же и по каско, должны были расторгнуть договор с первым страхователем, т. к. он уже не собственник этого авто, а потом страховать уже на нового владельца. в связи с этим, второй владелец на момент угона не был застрахован поэтому и выплаты не может быть.
2) Срок подачи заяления у каждой кампании по-разному от 3 до 5 дней, и причем различными способами: можно лично, по телефону, по факсу, телеграммой, если более точно не оговорено в договоре страхования. В договоре должна быть ссылка, если есть расхождения то преобладают правила по КАСКО . Попросите их в страховой, и уже на них ссылайтесь. Например, уехал бы собственник в другой город, и каким образом, он должен сообщить лично, такого просто не может быть. 🙂
5.Петров решил застраховать принадлежащую ему квартиру в пользу своей дочери. В страховом полисе квартира была оценена по рыночной стоимости. Однако в период действия договора ее рыночная стоимость увеличилась более чем на 1/3. При наступлении страхового случая страховщик отказался выплатить страховое возмещение, ссылаясь на то, что выгодоприобретатель не сообщил ему об обстоятельствах, влекущих изменение страхового риска. Дочь Петрова в ответ заявила, что ей не было ничего известно об увеличении стоимости квартир в данном районе, к тому же изменение стоимости предмета договора страхования не означает, что изменяется и риск.
