Чем отличается кадастровый паспорт от технического

Кадастровый паспорт на самом деле устаревшее название. В 2015 г. название «кадастровый паспорт» в отношение объектов недвижимости заменено на «технический план», а в отношение земельных участков — на «межевой план» (ФЗ № 218 «О госрегистрации ОН»).
Возможно, созвучность названий «техплан» и «техпаспорт» и породило ошибочное представление об идентичности кадастрового и технического паспорта. Расставим теперь все точки над «и»:
  • Кадастровый и технический паспорт (техплан и техпаспорт) — это разные, несмотря на созвучие, документы. И разница эта в правовом смысле.
  • Технический план помещения (межевой план земельного участка) и кадастровый паспорт — одно и тоже (хотя на слух ассоциации подобия не возникает).

Особенности кадастрового паспорта

Кадастровый паспорт (технический план помещения или межевой план земельного участка) — основной документ учета строений/помещений и земельных участков, а также их частей и долей в едином государственном реестре недвижимости (ЕГРН или Росреестр). КП представляет из себя выписку, которую можно заказать в ЕГРН. Паспорт имеет юридическую силу и необходим:
  • для оформления прав собственности;
  • долгосрочной аренды;
  • отчуждения имущества (купля-продажа, дарение, наследование и др.);
  • введения в эксплуатацию новых ОН.

  • КПТ (кадастрового плана территории);

Графическая часть может быть дополнена описанием основных элементов и их положения (по просьбе заказчика).
  • для зданий, жилых домов, сооружений, жилых и нежилых помещений (либо их частей);
  • объектов незавершенного строительства; машино-мест;
  • ЕНК (единых недвижимых комплексов).

Межевой план земельного участка

Межевой план (МП) очень важен в юридическом плане — он необходим для формирования, определения границ и постановки на учёт нового земельного участка. Создается на основе КПТ (кадастрового плана территории) или выписки из ЕГРН.

 Технический паспорт — это самый первый документ, который появляется у недвижимого объекта (квартиры или жилого дома) в результате инвентаризации при вводе дома в эксплуатацию. Получить технический паспорт можно в БТИ (бюро технической документации).

Чем отличается кадастровый паспорт от технического паспорта? Это распространённый вопрос граждан, которые впервые столкнулись с проблемами перепланировки или продажи недвижимости. Оба этих документа в настоящий момент являются официально действующими, и каждый из них выполняет свою определённую роль в вопросах регулирования имущественных отношений.

Кадастровый паспорт

Сначала следует понять, что собой представляет кадастровый паспорт, и какую он играет роль в вопросе постановки недвижимости на кадастровый учёт. Как известно, кадастровый учёт – это непременное и обязательное действие с каждым недвижимым объектом. По факту постановки на учёт объекту будет присвоен уникальный кадастровый номер, который «зафиксирует» место такого объекта в периметре всей существующей в стране недвижимости согласно специальной иерархии. Пока объект не будет поставлен на учёт, с ним нельзя производить никаких гражданско-правовых сделок по отчуждению, передаче в аренду или в залог, а также производить любые другие действия, так или иначе связанные с распоряжением таким объектом.

Кадастровый учёт обязателен для всех недвижимых объектов.
Кадастровый паспорт (далее – также «КП») в свою очередь – это тот документ, что подтверждает факт нахождения недвижимости на кадастровом учёте и фактически разрешает проведение с таким объектом любых не запрещённых законом операций. Росреестр «опознает» недвижимость только ту, которая есть в кадастре, и если информация имеется, то на такие объекты можно регистрировать право собственности. Такая вот взаимосвязь.

КП выдаётся для любых объектов недвижимости, в т. ч. для земельных наделов. Хотя здесь нужно сделать небольшую «поправку на ветер» — как вид документа КП больше не выдаётся – вместо него выдаётся выписка из ЕГРН. Данная выписка подтверждает нахождение объекта на кадастровом учёте. По сути, как именно называется документ – паспортом или выпиской, большого значения не имеет. По тексту будет применяться и то, и другое название. В КП содержится информация о технических характеристиках объекта. В частности, в нём указываются следующие сведения:

  • кадастровый номер (уникальный цифрокод, не повторяющийся для других объектов недвижимости);
  • адрес объекта;
  • дата постановки объекта на учёт;
  • вид объекта;
  • технические характеристики;
  • графическое изображение;
  • информация о собственнике и документах — основаниях;
  • иные сведения.

В состав документа включается также кадастровый план – графическая составляющая любого КП. План является обязательным приложением к любому КП.

Кадастровый паспорт выдаётся органами Росреестра, если объект на кадастровом учёте состоит. Если он в кадастре не значится, то перед тем, как иметь возможность получить КП, его необходимо поставить на учёт. А это делается путем предоставления в Ростреестр техплана на объект (если речь идет о зданиях, строениях) либо межевого плана (для земель). Оба эти документа могут быть изготовлены как органами БТИ, так и кадастровыми инженерами. Срок действия КП по закону не ограничивается какими-то рамками – он будет актуален до тех пор, пока актуальна содержащаяся в нём информация. Кадастровый паспорт актуален, пока не изменится информация, которая в нём содержится. Итак, кадастровый паспорт представляет собой не что иное, как обыкновенную выписку из ЕГРН, в которой содержится информация как о самом объекте и его характеристиках, так и о собственниках объекта. Самостоятельного значения такая выписка не имеет – она является следствием того, что объект на кадастровый учёт поставлен. Если необходимо получить определённые сведения об объекте, собственниках, обременениях, то такую выписку можно запросить в Росреестре. Сейчас база Росреестра единая – раньше регистрация прав и кадастровый учёт осуществлялись в разных базах, но с 2017 года они были объединены в единую – ЕГРН. Именно там и содержится вся информация как о правах на объект, так и о характеристиках объекта. Получить такие сведения может каждое заинтересованное лицо после уплаты госпошлины. Если планируется сделка с недвижимостью, то лучше сразу запросить кадастровый паспорт, чтобы узнать, действительно ли объект на кадастровом учёте состоит, и что нет никаких препятствий для сделки. Хотя по новым правилам, опять же с 2017 года, переход права и кадастровый учёт допускаются одновременно, однако времени на такую процедуру уйдет больше.  Если с объектом произойдут какие-то изменения, например, поменяются границы земельного участка, то информацию в кадастр придётся вносить заново. Соответственно, после таких изменений будет изменена и выдаваемая Росреестром выписка из ЕГРН.

Технический паспорт

С КП всё понятно – это просто выписка, в коей содержатся сведения об объекте и собственниках, и что данным документом «заведует» Росреестр. А что в свою очередь представляет паспорт технический? Технический паспорт (далее – также «Техпаспорт») – это документ, в котором также содержатся технические данные объекта. Это очень его роднит с выпиской из ЕГРН, от этого, видимо, и возникает такая путаница. Он создаётся только для зданий и помещений, для земельных участков техпаспорт не изготовляется. Техпаспорт создается как на здание в целом, так и на его отдельные помещения. На земельные наделы техпаспорт не составляется – только на здания и их составные части. Техпаспорт включает в себя следующие сведения об объекте:
  • дата ввода объекта в эксплуатацию;
  • площадь;
  • количество этажей;
  • материалы, из которого изготовлены стены и перегородки помещения;
  • произведённые с помещением перепланировки и даты таких перепланировок, если таковые, конечно, вообще были;
  • иные технические данные.

Техпаспорт составляется перед вводом объекта в эксплуатацию. Если никакие свойства объекта не изменялись, то его действие периодами времени не ограничивается – он бессрочен. Однако при перепланировках техпаспорт необходимо обновлять. Для чего техпаспорт нужен? Неужели недостаточно кадастрового паспорта? Дело в том, что действующим законодательством в обязательном порядке предусмотрено осуществление государственного учета жилищного фонда с его инвентаризацией и паспортизацией. Т. е. оформление техпаспортов для помещения жилого фонда обязательно в силу прямого указания закона. Техпаспорт как документ никуда не делся – он существует. Техпаспорт изготавливается государственным предприятием – БТИ. Кроме него изготовлением техпаспортов никто заниматься не имеет права. Кадастровые инженеры такого права лишены. Они могут изготавливать лишь техпланы и межевые планы.

Вот еще один документ, с которым техпаспорт постоянно путают – это технический план (техплан). Техплан необходим для осуществления кадастрового учёта.
Все сведения, необходимые для постановки на кадастровый учёт, содержатся в техплане – это первичные данные, которые вносятся в ЕГРН, когда объекту присваивается кадастровый номер.
До 2013 года такие сведения вносились по техпаспорту. Т. е. до 2013 года техпаспорт был для постановки на кадастровый учёт обязателен, а с 2013 обязателен только техплан. В настоящее время техпаспорт в процессе постановки на кадастровый учёт не участвует.

Техпаспорт может гражданину понадобиться для:

  1. Перевода объекта жилого фонда в нежилой;
  2. Получения разрешения на реконструкцию либо перепланировку;
  3. Для предоставления суду при необходимости;
  4. Для получение ипотечного кредита;
  5. Для признания дома аварийным.
С помощью данного документа оценивается безопасность здания как объекта недвижимости. Несмотря на то, что для постановки на кадастровый учёт техпаспорт больше не применяется, он не отменён в качестве официального документа и продолжает быть необходимым в определённых случаях.

Ключевые отличия

Итак, рассмотрев особенности паспорта кадастрового и технического, можно сделать выводы, чем именно они друг от друга отличаются:
  1. Кадастровый паспорт – это просто выписка из ЕГРН, которая подтверждает, что недвижимость состоит на кадастровом учёте. В ней отражаются все основные характеристики объекта, а также информация о собственниках и имеющиеся обременения. Для постановки на кадастровый учёт используется либо техплан, либо межевой план. До 2013 года для зданий и сооружений использовался техпаспорт, в настоящее время данной роли он больше не выполняет.
  2. Техпаспорт применяется для оценки в первую очередь «технической составляющей» здания и используется он в случаях перепланировки, реконструкции, перевода помещений из одного фонда в другой, а также при прочих вмешательствах в конструктивные особенности здания.
  3. Техпаспорт изготавливается БТИ, а выписка из ЕГРН выдаётся органами Росреестра.
Несмотря на очевидные отличия, содержание данных документов весьма схоже.
Каждому собственнику, который задумал продать объект недвижимости, необходимо убедиться, что он состоит на кадастровом учёте, а документом, подтверждающим это, является именно кадастровый паспорт. Если же владелец задумался о перепланировке помещения, то ему будут необходим технический паспорт, согласно которому и будет выдаваться разрешение или отказ. Несмотря на то, что документы в чём-то схожи, с правовой точки зрения они различаются кардинально – они выдаются разными органами и применяются для совершения различных юридических процедур.
